Terms and Conditions of Use of the Alfred Platform — Argentina

These Terms and Conditions ("Terms") govern the access to and use of the Alfred Platform ("Platform"), operated by Alfred Pay Labs LLC and its affiliates and subsidiaries (collectively, "Alfred").By accessing or using the Platform, you (the "Customer") agree to these Terms, the Privacy Notice, and any other linked legal documents. If you do not agree, you must refrain from using the Platform.

1. Definitions

  • Customer: A natural or legal person who accesses, registers with, or uses the Platform or any of its Services.
  • Platform: The digital medium provided by Alfred for the acquisition or exchange of digital assets.
  • Services: Services offered through the Platform, including but not limited to the purchase and exchange of digital assets.
  • Account: The account created by the Customer to access and manage the Services.
  • Funds: Resources deposited by the Customer to carry out operations within the Platform.

2. Eligibility and Restrictions of Use:

The Customer must be at least 18 years of age and have the legal capacity to act under Argentinian law. Use of the Platform for illegal or fraudulent purposes is prohibited. The use of the Platform is prohibited for residents or citizens of countries listed on international sanctions lists (OFAC, UN, EU) or classified as high-risk jurisdictions by the FATF. Alfred may suspend any account linked to such jurisdictions, as well as suspend or cancel accounts under criteria related to the prevention of money laundering and terrorist financing (AML/CFT).

3. Access to the Platform:

The Platform is available 24 hours a day, 7 days a week, except for interruptions due to maintenance or technical failures. Alfred will notify of relevant interruptions when possible.

4. Account Registration:

The Customer must complete the registration by providing personal information and documentation in accordance with the identity verification processes required by Law No. 25.246, the current regulations of the Financial Information Unit (UIF), and, where applicable, the applicable provisions issued by the Central Bank of the Republic of Argentina (BCRA) regarding the prevention of operations with funds of illicit origin. Alfred may report suspicious activities to the UIF and request additional information.

5. Security and Password:

The Customer is responsible for keeping their access credentials secret. Alfred does not store passwords and is not responsible for unauthorized access resulting from the Customer's negligence. It is recommended to activate two-factor authentication (2FA). Alfred may monitor operations through technological tools to detect unusual, suspicious, or high-risk activities, reserving the right to temporarily suspend services until the legality of the operations is verified.

6. Description of the Services:

Alfred provides a Platform for the acquisition and exchange of digital assets. It does not offer financial advice, guarantee returns, nor does it act as a custodian or provider of virtual wallets under Argentinian regulations. The Customer acknowledges the decentralized and highly volatile nature of digital assets, and accepts that operations are carried out at their sole risk, which may imply the total loss of the invested value. Assets are not backed by any governmental or financial entity.

7. Fees and Taxes:

The use of the Platform does not generate registration fees. Transaction fees are available on the Platform. The Customer is responsible for declaring and paying taxes derived from their operations, in accordance with Argentinian tax law and the provisions of the Federal Administration of Public Revenue (AFIP).

8. Protection of Personal Data:

The Customer's personal data will be treated in accordance with Law No. 25.326 and its complementary regulations. Alfred adopts the administrative, technical, and physical measures necessary to protect information. The Customer may exercise their rights of access, rectification, update, or deletion by writing to: support@alfredpay.com. Alfred may share Customer information with Argentinian and international authorities when required by an investigation, audit, judicial process, or request in accordance with international treaties or cooperation agreements

9. Refunds and Cancellations:

Given the irreversible nature of operations with digital assets, transactions cannot be canceled or refunded once executed. In exceptional cases, and at the sole discretion of Alfred, a refund request may be considered.

10. Use of External Wallets and Incompatible Assets:

The Customer may use external wallets under their own responsibility. It is their duty to verify the compatibility of the assets and addresses, recommending the use of ERC-20/BEP-20 standards according to the supported assets. Alfred is not responsible for losses derived from compatibility errors or incorrect addresses.

11. Intellectual Property:

All content on the Platform (software, logos, texts, etc.) is the property of Alfred. Its unauthorized use, reproduction, or modification without express written permission is prohibited.

12. Confidentiality:

The Customer agrees not to disclose or misuse confidential information obtained through the Platform.

13. Advertising and Third-Party Content:

The Platform may display advertisements or links to third-party content. Alfred does not endorse or is responsible for such content. The Customer assumes the risk when accessing third-party links.

14. Modifications:

Alfred may modify these Terms at any time. Modifications will take effect upon publication. Continued use of the Platform implies acceptance of the modifications.

15. Exclusion of Warranties:

The Platform is offered "as is" and "as available." Alfred does not guarantee its error-free operation or that it is free from cyber threats. Nor does it guarantee the valuation of digital assets or is responsible for losses derived from events of force majeure.

16. Limitation of Liability:

To the extent permitted by Argentinian law, Alfred will not be liable for indirect damages, service interruptions, data loss, or financial losses derived from the use of the Platform.

17. Applicable Law and Dispute Resolution:

These Terms are governed by the laws of the Republic of Argentina. Any controversy will be resolved through arbitration administered by the General Arbitration Tribunal of the Buenos Aires Stock Exchange, in accordance with its regulations, in Spanish, and with headquarters in the Autonomous City of Buenos Aires.

18. Account Termination:

The Customer may request the closure of their account at any time. Alfred will establish the applicable procedures for the liquidation of funds and deletion of data in accordance with Law No. 25.326.

19. Digital Consent:

The Customer accepts that the electronic acceptance of these Terms has full legal validity in accordance with Law No. 25.506 on Digital Signatures.

20. Customer Declarations:

The Customer declares under oath that the funds used on the Platform come from legal activities, and is obliged to provide supporting documentation if required by Alfred or a competent authority. The Customer acknowledges and accepts Alfred's internal policies, including those on the prevention of money laundering, sanctions, transaction monitoring, and risk management.

21. Limits and Retention of Funds:

Alfred may establish operational limits to Customer transactions and temporarily retain funds in case of compliance review, authority requirement, or additional validation of identity or origin of funds.

23. Acceptance of the Terms:

By creating an Account or using any part of the Platform, the Customer acknowledges having read, understood, and accepted these Terms, as well as the Privacy Notice.

24. Availability of Versions by Country:

To comply with local regulations, Alfred makes available specific versions of these Terms and Conditions for the following countries:

  • Brazil
  • Argentina
  • Mexico
  • Peru
  • Dominican Republic
  • Colombia

25. Provisions on Availability of Services, Technical Support, and Means of Contact:

  • 25.1. Availability of Services: The Services offered by Alfred will be available 24 (twenty-four) hours a day, 7 (seven) days a week, except for interruptions derived from scheduled maintenance, technical failures, fortuitous event or force majeure. Alfred will make its best efforts to promptly communicate to the Customer any interruption that significantly affects the operation of the Platform.
  • 25.2. Technical Support: Alfred makes available to the Customer technical support for queries related to access, use of the Platform, operations, security, errors, or any technical incident. Support will be provided in Spanish through the designated channel and during business hours from Monday to Friday from 9:00 a.m. to 6:00 p.m. (Argentinian official time), excluding national holidays.
  • 25.3. Means of Contact: The Customer may contact Alfred through the email address support@alfredpay.com, as well as through the contact form located on the Platform. Alfred will respond to requests within a maximum period of 5 (five) business days. In urgent cases, it is recommended to include the word "URGENT" in the subject of the email.
  • 25.4. Updates and Interruptions: Alfred may make improvements, updates, or modifications to the Platform that imply temporary interruptions of the service. In such cases, it will endeavor to notify at least 24 (twenty-four) hours in advance by email or notice on the Platform.
  • 25.5. Limitation of Liability for Interruptions: Alfred will not be responsible for interruptions that are not attributable to it, such as failures of internet providers, problems in the Customer's network, cyber attacks or events of force majeure. However, it undertakes to investigate and remedy incidents under its control as soon as technically possible.
