Alfred Technology Labs Corp (hereinafter "ALFRED"), domiciled at 2420 Brickell ave 302B Miami FL 33129, hereby and in order to comply with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals (hereinafter the Law), ALFRED provides this Privacy Notice to inform you how we collect, transfer, store and use personal data, under the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility.
ALFRED is responsible for collecting, processing and protecting personal data in order to a) Verify the identity of its clients and the veracity of the information they provide as their own; b) Formalize a contractual relationship between the client and ALFRED in order to provide the services contracted in accordance with the agreement between the parties; c) To compile files and databases of its clients, either directly by ALFRED or through a third party, and to report such information to the competent authorities when required by current legal provisions; d) To offer its clients an extension or improvement of the products or services contracted; e) To offer benefits, promotions or discounts to its clients, and other purposes that ALFRED may determine in its policies in connection with the contractual and/or commercial relationship it may have with its clients.
In addition to the purposes described in the previous paragraph, it is important that the client understands that ALFRED requires the collection of this information in order to carry out activities inherent to the contracted services, such as, but not limited to, the following:
Personal data may be collected by ALFRED directly, by a third party or through other sources permitted by law and will be processed for the sole purpose of carrying out and following up on the process of contracting with ALFRED for any product and/or service provided by ALFRED.
Customers shall provide the information at the time of initiating the contracting process mentioned in the previous paragraph and when signing this Notice, as well as when modifying the information provided to ALFRED.
The personal data to be collected may include the following:
Information about your use of the Sites and Services is also automatically collected through cookies, web beacons, java script, log files, pixels and other technology, which may include: your domain name, browser type, browser language preference, device type and operating system, page views and links you click within the Sites, IP addresses, device ID or other identifier, location information, indication of date and time and time you used the Services, referring URL and your activity within the Sites.
Should the customer fail to provide the aforementioned information, ALFRED may refrain from providing its services. The customer declares that the personal data provided to ALFRED are true and up to date and undertakes to inform ALFRED of any changes to the personal data provided as soon as possible through the means established for this purpose by ALFRED. The data collected by ALFRED directly from the customer shall be collected through the electronic means made available. ALFRED may carry out investigations, obtain photographs, conduct interviews and, in general, carry out any actions it deems necessary to verify, by itself or through third parties hired specifically for this purpose, the veracity of the personal data provided by the customer.
The same treatment referred to in this Notice, will have the personal data collected in the future, the customer may at any time exercise their right of opposition, as provided in this Notice.
ALFRED does not request any information that under the Law is understood as sensitive data, such as religion, sexual preferences, political opinions, among others. At ALFRED we support and encourage diversity; we prohibit any discriminatory act or the request of any information that could imply a discriminatory act.
The processing of the information collected by ALFRED will have the necessary treatment for the sole purpose indicated in section I of this Privacy Notice.
Also, in addition and as secondary purposes, which although not necessary for the legal relationship between ALFRED and the customer, will allow, where appropriate, to provide various additional services or products, or improve those already provided and provided: (i) offer benefits, promotions or discounts to the customer in order to encourage or reward the use of products or services marketed by ALFRED; (ii) share information with third parties to provide the customer with additional channels and (iii) develop quality and satisfaction surveys, regarding the products contracted.
If the customer does not want his/her personal data to be processed for the secondary purposes, he/she should express his/her refusal to ALFRED's contact information, as indicated in this Notice.
ALFRED uses its clients' personal data exclusively for the purposes indicated in this Notice and keeps them for the period indicated in the applicable legal provisions. By accepting this Notice, it is understood that the client authorizes ALFRED to transfer his or her personal data to third parties, whether Mexican or foreign, without the need to obtain his or her consent again. ALFRED shares and transfers the data collected in the following cases
ALFRED shall comply at all times with the principles of personal data protection in accordance with the Law and its regulations, and shall therefore require that third parties to whom it transfers personal data comply with the Law and adopt the necessary measures for their protection.
Third parties and entities receiving personal data will assume the same obligations and/or responsibilities that ALFRED has assumed with the client.
Customers will be responsible for the accuracy, veracity, authenticity and validity of their data, and may at any time exercise their ARCO Rights.
ACCESS: The customer has the right to access his/her personal data held by ALFRED, as well as to know this Notice.
RECTIFICATION: The customer may request ALFRED to rectify their personal data if it is out of date, inaccurate or incomplete. To exercise this right, the customer must provide ALFRED with documentation proving the requested rectification in accordance with the personal data.
CANCELLATION: The client may request the blocking and deletion of personal data from ALFRED's databases and records when it considers that it is not being used properly or for the purposes that gave rise to the legal relationship, however ALFRED shall not be obliged to cancel personal data when: (a) It refers to the parties to a private, social or administrative contract and is necessary for its development and compliance; (b) They must be processed by legal provision; (c) It obstructs judicial or administrative proceedings related to tax obligations, the investigation and prosecution of crimes or the updating of administrative sanctions; (d) They are necessary to protect the legally protected interests of the client; (e) They are necessary to perform an action in the public interest; and, (f) They are necessary to comply with an obligation legally acquired by the client.
If the personal data was transmitted prior to the date of rectification or deletion and continues to be processed by third parties, ALFRED will inform the third parties of the request for rectification or deletion, so that they may proceed with the rectification or deletion.
OPPOSITION: The customer may object to the processing of his personal data.
The exercise of any of the ARCO Rights does not prevent the exercise of any other right. In the event that the customer wishes to exercise any of its ARCO rights, it must make such request in writing to the email hola@alfredpay.io such request must contain at least the following:
The client accepts and acknowledges that, in case of carrying out the processing of personal data of third parties, it is obliged in terms of the LFPDPPP to have its own Privacy Notice that legally allows it to collect, store, use, transfer, handle and dispose of the personal and sensitive data of its own customers (hereinafter "Third Parties").
Likewise, the client is obliged to establish in its Privacy Notice the authorization of its clients, allowing it to transfer their personal and sensitive data in favor of ALFRED so that ALFRED may process such personal and sensitive data in order to comply with the provision of services between ALFRED and the client.
The customer shall be solely responsible for complying with the obligations agreed in this section. In the event that the customer fails to comply and ALFRED is directly or indirectly affected by this failure, the customer undertakes to hold ALFRED harmless, and shall be liable for any damage or loss that may arise to the detriment of ALFRED.
The personal data collected may be processed in order to enable the customer to meet legal requirements of competent authorities.
ALFRED may make changes to this Notice, in strict compliance with the Law and its regulations. If such changes are made, ALFRED will provide the client with information about them, as well as the new Privacy Notice through ALFRED's platform, website or any other means ALFRED may determine for such purpose.
In accordance with the provisions of this paragraph, the customer shall be responsible for keeping its e-mail account, address and other location data for notifications updated and to ensure that notifications are received in a medium that is constantly reviewed. If no objection is received by the client within 10 days after the Notice has been made available to him/her, it will be understood that he/she accepts the changes that the Notice may undergo.
By making this Privacy Notice available and in the absence of any objection by the client, it shall be understood that the client grants ALFRED its consent to process the personal data provided and/or those provided in the future for any of the purposes set forth herein.
At any time, you may revoke the consent you have given us for the processing of your personal data, so that we stop using them. To do so, it is necessary to submit your request in the terms mentioned for the exercise of the ARCO Rights.
If you believe that your right to protection of personal data has been violated by any conduct of our employees or our actions or responses, and you presume that in the processing of your personal data there is any violation of the provisions of the Federal Law for the Protection of Personal Data Held by Private Parties, you may file a complaint or complaint with the IFAI.
